Iselino – Terms, Policies & Legal Framework

This document contains the complete, professional legal framework for Iselino, a freelance marketplace platform operated by Fina Group d.o.o., Montenegro.
1. General Terms & Conditions (Platform Terms)
1.1 About Iselino
Iselino is an online marketplace platform that enables independent service providers (“Sellers”) to offer services to customers (“Buyers”).
Iselino acts solely as an intermediary and technical platform provider.
Iselino operates solely as a technology platform that facilitates connections between Buyers and Sellers. Iselino does not employ Sellers, does not supervise their work, and does not guarantee the quality, legality, or safety of services offered on the platform.
Iselino is not a party to the service contract between Buyer and Seller and does not provide the services listed on the platform.
No employment, agency, partnership, or joint venture relationship is created between Iselino and Sellers.
1.2 Account Registration
Users must be at least 18 years old.
Information provided must be accurate and kept up to date.
Users are responsible for maintaining the security of their accounts.
Each user may maintain only one account unless expressly authorized.
User accounts are personal and may not be transferred, sold, or assigned to another person.
Iselino reserves the right to suspend or terminate accounts that violate these Terms.
1.3 Use of the Platform
Users agree to:
Use the platform lawfully
Not infringe third-party rights
Not upload misleading, illegal, or harmful content
Not interfere with platform security or operations
1.4 Off-Platform Transactions
Users may not attempt to bypass the platform by arranging payments or services outside Iselino.
Accounts engaging in such activity may be suspended or terminated.
2. Seller Terms
2.1 Seller Status
Sellers act in their own name and on their own behalf. Sellers are solely responsible for:
The accuracy of service listings
Delivery and quality of services
Compliance with applicable laws and taxes
2.2 Seller Taxes
Sellers are solely responsible for declaring and paying any taxes arising from their income, including income tax, VAT, or similar taxes in their jurisdiction.
Iselino does not withhold income taxes on behalf of Sellers unless required by law.
2.3 Seller Verification (KYC)
Sellers may be required to complete identity verification procedures before offering services on the platform.
Verification may include:
Government-issued identification
Proof of address
Business registration documents (for companies)
Iselino reserves the right to suspend or restrict accounts if verification requirements are not fulfilled.
3. Buyer Terms
3.1 Purchasing Services
By placing an order, the Buyer enters into a direct contract with the Seller.
Iselino does not guarantee service outcomes, completion times, or results.
3.2 Consumer Rights (EU Buyers)
If the Buyer is a consumer located in the European Union, statutory consumer protection laws apply.
For digital services, the Buyer expressly agrees that the service may begin immediately and acknowledges that the statutory right of withdrawal may be lost once performance has started.
4. Payments, Fees & Commissions
4.1 Payments
Payments are processed through authorized third-party payment service providers, which may include Paymentwall or other approved providers.
Funds may be held in escrow until service completion is confirmed.
4.2 Platform Fees
Iselino charges platform service fees on completed transactions.
Seller commissions are applied based on the total transaction amount (excluding applicable taxes):
€1 – €100: 10%
€101 – €500: 9%
€501 – €2,000: 8%
€2,001 – €5,000: 7%
€5,001 and above: 5%
The applicable Seller commission is automatically deducted from the Seller’s payout.
In addition, Buyers are charged a 5% platform service fee on all transaction amounts, which is added to the total price at checkout.
This fee is non-refundable once a transaction has been initiated.
All applicable fees are clearly displayed before order confirmation.
4.3 Escrow System
Payments may be held in escrow until the Buyer confirms that the service has been completed in accordance with the order requirements.
If a dispute arises, Iselino may review the case and determine the appropriate release of funds between Buyer and Seller.
4.4 Seller Payouts
Seller earnings may be withdrawn once funds are cleared and the order is marked as completed.
Iselino may apply security holding periods, verification checks, or minimum withdrawal thresholds before payouts are processed.
Payouts are processed through approved payment providers and may be subject to processing times or additional verification requirements.
5. Tax & VAT Policy
5.1 Platform Fees & VAT Treatment
Iselino provides electronically supplied intermediary services.
The underlying service contract is exclusively between Buyer and Seller.
Iselino is not the supplier of the listed services.
VAT treatment depends on customer location and tax status.
(a) EU Consumers (B2C)
VAT may be applied to platform service fees according to the VAT rate applicable in the Buyer’s Member State.
Iselino may register under the EU VAT One-Stop-Shop (OSS) Non-Union Scheme to report and remit VAT.
(b) EU Businesses (B2B)
If a valid EU VAT identification number is provided, VAT may not be charged and reverse-charge mechanisms may apply.
(c) Non-EU Customers
No EU VAT is applied to platform service fees for customers outside the European Union unless required by international tax regulations.
5.2 Prices
Unless otherwise stated, all prices are displayed excluding VAT.
Sellers remain responsible for taxation related to their own services.
6. Cancellations, Refunds & Disputes
6.1 Cancellations
Orders may be cancelled before work begins unless otherwise agreed.
6.2 Disputes
If a dispute arises, Users must attempt resolution through platform communication tools.
Iselino may act as a neutral mediator. Any decision made by Iselino regarding fund release is final to the extent permitted by law.
6.3 Chargebacks
In the event of a chargeback or payment dispute, Iselino may temporarily suspend the Seller account while the case is reviewed.
Accounts with repeated chargebacks may be suspended or terminated.
7. Intellectual Property
Sellers retain ownership of their work unless otherwise agreed.
By uploading content, Users grant Iselino a non-exclusive, worldwide, royalty-free license to display and promote such content on the platform.
Users represent and warrant that they own or have the necessary rights to use and upload all content submitted to the platform.
8. Limitation of Liability
To the maximum extent permitted by law:
Iselino is not liable for service quality or user conduct.
Iselino is not liable for indirect or consequential damages.
Total liability is limited to fees paid to Iselino in the preceding 12 months.
Iselino does not guarantee uninterrupted, secure, or error-free operation of the platform.
9. Force Majeure
Iselino shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, war, government actions, internet outages, or technical failures.
10. Suspension & Termination
Iselino may suspend or terminate accounts for violations, fraud, abuse, or legal risk.
11. Sanctions & Compliance
Users may not access or use the platform if they are located in, or residents of, jurisdictions subject to international sanctions.
Accounts may be screened against global sanctions lists, including:
OFAC Sanctions List
EU Consolidated Sanctions List
United Nations Sanctions List
12. Fraud Prevention
Iselino uses automated monitoring systems and manual moderation to detect fraudulent activity, scams, or suspicious listings.
Accounts suspected of fraud may be suspended or permanently removed.
Iselino may request additional information or documentation from Users to comply with anti-money laundering (AML) and financial regulatory requirements.
13. Listing Moderation
Listings may be subject to automated review and manual moderation before or after publication.
Iselino reserves the right to remove any listing that violates these Terms or applicable laws.
14. Prohibited Services
The following services are strictly prohibited, except when offered by licensed professionals:
Illegal goods or services
Adult or sexual services
Drug-related services
Weapons or explosives
Fraudulent or deceptive activities
Hacking or cybersecurity attacks
Fake reviews or manipulation services
Gambling or betting services
Allowed only by licensed professionals:
Medical services
Legal services
Financial or investment advice
Iselino reserves the right to remove listings and suspend accounts violating this policy.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of Montenegro.
Exclusive jurisdiction lies with the competent courts in Bar, Montenegro.
16. Privacy & Data Protection
Personal data is processed in accordance with Iselino’s Privacy Policy and applicable data protection laws, including GDPR where applicable.
17. Changes to These Terms
Iselino reserves the right to modify or update these Terms at any time.
Users will be notified of significant changes through the platform or via email.
Continued use of the platform after such changes constitutes acceptance of the updated Terms.
